BASIC SUMMARY

  1. LEGAL BASIS FOR PROCESSING PERSONAL DATA
    1. performance of a contract between you and the controller, or for taking steps by the controller prior to entering into such a contract within the meaning of Article 6(1)(b) of Regulation (EU) 2016/679 of the European Parliament and of the Council on the protection of natural persons with regard to the processing of personal data and on the free movement of such data, repealing Directive 95/46/EC (General Data Protection Regulation) (hereinafter the “Regulation”);
    2. compliance with legal obligations to which the controller is subject, within the meaning of Article 6(1)(c) of the Regulation, specifically obligations imposed on the controller by generally binding legal regulations, in particular Act No. 235/2004 Coll., on Value Added Tax, as amended, Act No. 586/1992 Coll., on Income Taxes, as amended, and Act No. 563/1991 Coll., on Accounting, as amended.
    1. The legal basis for processing your personal data is the fact that such processing is necessary for:
  1. PURPOSE OF PROCESSING PERSONAL DATA
    1. The purpose of processing your personal data is the performance of a contract between you and the controller, including delivery of goods and resolution of liability for defects, or taking steps by the controller prior to entering into such a contract, and further compliance with related public-law obligations by the controller.
    2. The controller does not carry out automated individual decision-making within the meaning of Article 22 of the Regulation.
  1. PERIOD OF STORAGE OF PERSONAL DATA
    1. Your personal data will be processed for the duration of the rights and obligations arising from the contract and thereafter for the period necessary for archiving purposes under applicable legal regulations, but not longer than the period specified by applicable law.
  1. OTHER RECIPIENTS OF PERSONAL DATA
    1. Other recipients of your personal data will be shipping companies and other persons involved in the delivery of goods or the execution of payments under the purchase contract, and persons providing technical services for the controller related to the operation of the e-shop, including software operation and data storage. Other recipients of your personal data will be:

    2. Recipients of your personal data processed for the purpose of complying with legal obligations may also include tax authorities or other competent authorities in cases where this is imposed on the controller by generally binding legal regulations.
    3. The controller does not intend to transfer your personal data to a third country (outside the EU) or to an international organisation.
  1. DATA SUBJECT RIGHTS
    1. Under the conditions set out in the Regulation, you have the right to request from the controller access to your personal data, the right to rectification or erasure of your personal data, or restriction of their processing, the right to object to processing of your personal data, and the right to data portability.
    2. If you believe that the processing of your personal data has infringed or is infringing the Regulation, you also have the right to lodge a complaint with a supervisory authority.

You are not obliged to provide personal data. The provision of your personal data is a necessary requirement for the conclusion and performance of a contract, and without the provision of your personal data it is not possible to conclude or perform the contract by the controller.

Consent to Processing of Personal Data and Information about Processing

This consent to the processing of your personal data is given to Speedway Factory s.r.o. for the purpose of sending commercial communications (marketing offers) and for carrying out other marketing activities towards you. You may withdraw this consent at any time, and commercial communications will no longer be sent to you. More detailed information on the processing of your personal data is provided below.

The legal basis for the processing of your personal data is your consent given to the controller within the meaning of Article 6(1)(a) of Regulation (EU) 2016/679 of the European Parliament and of the Council on the protection of natural persons with regard to the processing of personal data and on the free movement of such data, repealing Directive 95/46/EC (General Data Protection Regulation) (hereinafter the “Regulation”).

    1. The purpose of processing your personal data is the sending of commercial communications and other marketing activities by the controller towards you.
    2. The controller does not carry out automated individual decision-making within the meaning of Article 22 of the Regulation.
  1. PERIOD OF STORAGE OF PERSONAL DATA
    1. The period for which your personal data will be stored by the controller is 24 months from the date of granting consent for commercial communications and marketing, but not longer than until you withdraw your consent to the processing of personal data (for this purpose of processing).
  1. OTHER RECIPIENTS OF PERSONAL DATA
    1. Other recipients of your personal data will be persons providing marketing services for the controller, Speedway Factory s.r.o.
    2. The controller does not intend to transfer your personal data to a third country (outside the EU) or to an international organisation.
  1. DATA SUBJECT RIGHTS
    1. Under the conditions set out in the Regulation, you have the right to request from the controller access to your personal data, the right to rectification or erasure of your personal data, or restriction of their processing, the right to object to processing of your personal data, and the right to data portability.
    2. You have the right to withdraw your consent to the processing of your personal data given to the controller at any time. This does not affect the lawfulness of processing of your personal data based on consent before its withdrawal. You may withdraw your consent to the processing of personal data in the following way: by sending an email to the controller at speedway@esospeedway.com requesting withdrawal of consent (this message must be sent from the email address for which the consent was granted).
    3. If you believe that the processing of your personal data has infringed or is infringing the Regulation, you also have the right to lodge a complaint with a supervisory authority.
    4. You are not obliged to provide personal data. The provision of your personal data is not a legal or contractual requirement and is not a requirement necessary for entering into a contract.

You have the right to object at any time to the processing of your personal data for direct marketing purposes, including profiling, insofar as it relates to such direct marketing. If you object to processing for direct marketing purposes, your personal data will no longer be processed for such purposes.

Final Provisions

  1. Under the conditions set out in the Regulation, you have the right to request from the controller access to your personal data, the right to rectification or erasure of your personal data, or restriction of their processing, the right to object to processing of your personal data, and the right to data portability.
  2. The data subject has the right to contact the Office for Personal Data Protection (www.uoou.cz).
  3. These Principles shall enter into force on 25 May 2018.
